Terms and Conditions of MicroSIM promotion
   
 
1. This “iPack” promotion is applicable to individual TrueMove Post Pay users who have their account activated with Micro SIM during the period from 15 June to 31 August 2010 or until further notice and valid for a period of 6 months (billing cycles) from the date of activation.
   
2. Service fee for this promotion covers the following details:
 
     
2.1   Minimum monthly fee is 899 Baht covering the following services:
     
    2.1.1 Allowance for unlimited EDGE/GPRS access per month (billing cycle);
     
    2.1.2 Allowance for unlimited Wi-Fi (2 Mbps) access per month. The users should learn about conditions of Wi-Fi by TrueMove (Unlimited Package) as provided below.
     
2.2   Monthly fee of 699 Baht covers the following services:
     
    2.2.1 Allowance for unlimited EDGE/GPRS access per month (billing cycle);
     
    2.2.2 Allowance for Wi-Fi (1 Mbps) access as per the following details: fee for Wi-Fi service is charged in addition to the minimum monthly fee at 0.50 Baht (50 Satang) per minute based on per minute billing with a fraction of each minute counted as one minute;
     
    2.2.3 Those who subscribe for 699 Baht monthly package are entitled to the following privileges upon having Micro SIM activated:
     
    (1) Allowance for making calls of 300 minutes per month. The excess of monthly allowance is charged in addition to the minimum monthly fee at 1.50 Baht per minute for calls made to any networks throughout 24 hours based on per minute billing with a fraction of each minute counted as one minute;
     
    (2) The users are eligible to send 300 SMS per month. The excess of monthly allowance is charged in addition to the minimum monthly fee at 3 Baht per SMS throughout 24 hours;
     
    (3) The users are eligible to send 120 MMS per month. The excess of monthly allowance is charged in addition to the minimum monthly fee at 5 Baht per MMS throughout 24 hours.
     
3. Privilege: Eligible for 3G* service free of charge from the date of registration until 31 December 2010 or until further notice according to the following minimum monthly fees:
   
 
3.1   Those who are subscribe to minimum monthly fee of 899 Baht are entitled to free of charge 3G* service of 5,000 megabytes (5 GB) per month (billing cycle;
     
3.2   Those who are subscribe to minimum monthly fee of 699 Baht are entitled to free of charge 3G* service of 5,000 megabytes (5 GB) per month (billing cycle;
     
3.3   Upon reach of allowance, 3G service will be automatically disconnected and the users are able to access 3G free of charge service again in the following month (billing cycle). However, the 3G service cannot be rolled over or exchanged, changed or refunded for cash or any other items or transferred to any other persons;
   
  Remark: 3G service is part of network improvement and development in certain areas for TrueMove better service. It is on a trial period and available in permitted areas. TrueMove reserves the rights to amend, change, suspend or discontinue its 3G service at any time as it deems appropriate with advance notice through any appropriate communication channels. 2G and 3G receivers are subject to the user’s device.
   
4. During this promotion period, the users are able to sign up for additional Wi-Fi/EDGE/GPRS packages on Call Center 08-2000-3333.
   
5. Existing postpaid users may switch to this promotion subject to terms and conditions and discretion set forth by TrueMove.
   
6. All aforesaid fees are exclusive of value added tax.
   
7. Terms and Conditions of Wi-Fi/EDGE/GPRS
 
     
7.1   It shall be deemed that the users of EDGE/GPRS and Wi-Fi services of the aforesaid packages acknowledge and accept all specified Terms and Conditions set forth by TrueMove and True Internet;
     
7.2   EDGE/GPRS system is a SIM card based service in which the users are able to get access via an EDGE/GPRS enabled mobile phone;
     
7.3   A system setup is needed before connecting to EDGE/GPRS offered by TrueMove and Internet service offered by True Internet. For more information on system setup, the users should read the user’s manual or contact the manufacturer;
     
7.4   TrueMove and True Internet shall exercise due caution for the Wi-Fi/EDGE/GPRS offered by TrueMove and Internet service offered by True Internet. However, the users shall also foster awareness for their own personal computer, notebook or other wireless devices to prevent it from hacking or software viruses. (It is recommended that the Users install a firewall or anti-virus program);
     
7.5   TrueMove and True Internet reserve the rights not to be responsible for any loss or damage or loss of data occurred from delay or disruption of data service or access failure, hazardous data or content download. In this matter, the users shall take sole responsibility for such act and ensure that such downloaded content or data comes from a reliable source;
     
7.6   Wi-Fi by TrueMove users are able to use their TrueMove mobile number as username followed by @truemove domain name (08xxxxxxxx@truemove) and password to get access to the Internet and should reset password after activation;
     
7.7   In case of forgetting password, the users are able to request for new password by dialing 1331 or *9000 press 4;
     
7.8   The Internet service offered by True Internet Co., Ltd. (True Internet) will be disconnected every 90 minute for checking and tracking traffic usage. To reconnect, the users need to switch off and switch on the receiver;
     
7.9   In case of forgetting to log out or inactive usage over 10 minutes, the system will be automatically logged out;
     
7.10   A Wi-Fi by TrueMove account allows one concurrent user only.
     
8. Upon change from this promotion, the right/privilege/eligibility under this promotion is ceased and cannot be changed, exchanged or refunded for cash or any other items or transferred to any other persons.
   
9.

“Objectives of the contract”: The user agrees to use the service under this promotion for normal, personal and individual use with honest interest, not for otherwise. The user shall not use, exploit, modify or commit any act on technology or system or any other devices so as to connect or relate to such service and shall not commit or omit any act that can be described or anticipated or believed that it shall cause an immoral act or a damage or an unfair treatment to TrueMove or any other person directly or indirectly or disturbance or inconvenience or hazard to network or make the network or its part malfunction in any way.

If the user commits any act according to the aforesaid paragraph, it shall be deemed that the user offends the objectives of the contract. TrueMove reserves the rights to immediately terminate its service under this contract if there is a reasonable ground to believe that the User uses the services by any of the following ways:

   
 
     
9.1   Use the services against the contract or the prohibition of the contract or offend the objectives of the contract or has a dishonest intention towards the service or commit any act that causes or can be anticipated or believed that it shall cause damage to TrueMove in any way; or
     
9.2   Use the service by way of defraud; or
     
9.3   Use the service illegally.
 
   
10. TrueMove reserves the rights to suspend, change or terminated the aforesaid Terms and Conditions if there is illegal act or failure to comply with specified Terms and Conditions without prior notice.
   
11. Unless stated otherwise, TrueMove reserves the rights to amend, change or terminate the aforesaid Terms and Conditions with advance notice at least 30 days through any appropriate communication channels.
   
12. TrueMove reserves the rights to suspend or terminate its service under this promotion if there is any regulation, order or policy set forth by any relevant public authority stated otherwise causing TrueMove to change, suspend or terminate any Terms and Conditions of this promotion so as to comply with such regulation, order or policy or if TrueMove considers that there is any dishonest behavior or fraud of document so as to take advantage of this promotion or abuse of mobile service or any illegal act or failure to comply with Terms and Conditions of this promotion without prior notice.

Terms and Conditions of Wi-Fi by TrueMove service (Unlimited Package)
   
 
1. This Wi-Fi promotion is applicable to TrueMove Post Pay users who subscribe as individual (non corporate) person.
   
2. The users are able to sign up for this package at the login page on www.truewifi.net.
   
3. This package is based on auto authentication which is deemed that the users have received username and password according to the Computer Crime Act B.E. 2550 and/or any other laws prescribing offences on use of computer and Internet network.
   
4. Auto Authentication system can be used with only specified device which is not working with any other Wi-Fi enabled mobile phone or notebook.
   
5. Those who sign up for this package cannot apply for Pay Per Use or hi-speed net package. On the other hand, those who use Pay Per Use or hi-speed net package and sign up for this package can instantly switch to this package (effective immediately) but the users are required to terminate the hi-speed net package via *9000 (free of charge). The users are able to order other Wi-Fi by TrueMove packages e.g. 1-hour or 1-day package via SMS on 9434 for use with other Wi-Fi enabled mobile phones or notebooks subject to this Terms and Conditions. 6. Wi-Fi by TrueMove offers connection speed up to 1 Mbps per account.
   
7. Wi-Fi by TrueMove users shall take responsibility to keep the auto authentication device as per Clause 2 confidential to prevent it from an unauthorized use. TrueMove and True Internet reserve the rights not to be responsible for any damage occurring from such unauthorized use.
 
     
8. The users are required to learn more about information and how to use the Internet service before applying for service.
   
 
8.1   A system setup and installation is needed before connecting to Wi-Fi by TrueMove. The users shall find out more information on system setup and installation on 02-900-9000 press 89;
     
8.2   During the service period, Wi-Fi by TrueMove will be disconnected every 90 minute (session time out) for monitoring and tracking usage. If wishing to continue going online, the users are required to switch off and switch on the receiver again;
     
8.3   The users are able to use the service at any Wi-Fi by TrueMove hotspots nationwide and can check the service areas on www.truewifi.net or more information on 0-2900-9000 press 89;
     
8.4   The users cannot use roaming service at the KSC hotspot areas except using additional services via SMS 9434 subject to Terms and Conditions on www.truewifi.net;
     
8.5   In case of being inactive for 10 minutes, the system will be automatically logged out;
     
8.6   A Wi-Fi by TrueMove account allows one concurrent user only;
     
8.7   Despite the fact that the users are eligible for unlimited usage of Wi-Fi by TrueMove or Internet offered by True Internet, TrueMove and True Internet shall not guarantee that Users can get access at all times or from all places;
     
8.8   TrueMove and True Internet shall exercise due caution for the Wi-Fi by TrueMove service. However, the users shall also foster awareness for their own personal computer, notebook or other wireless devices to prevent it from hacking or software viruses. (It is recommended that the Users install a firewall or anti-virus program);
     
8.9   TrueMove reserves the rights not to be responsible for any loss or damage or loss of data occurred from delay or disruption of data service or access failure, hazardous data or content download. In this matter, the users shall take sole responsibility for such act and ensure that such downloaded content or data comes from a reliable source;
     
8.10   TrueMove and True Internet reserve the rights to terminate this promotion if there is an announcement or a change of service rate as a result of order and/or policy of any relevant public authority. Additionally, TrueMove reserves the rights to adjust such aforesaid service rate(s) without prior notice;
     
8.11   TrueMove reserves the rights to suspend or terminate the services under this promotion if it considers that there is any dishonest or fraud of document so as to take advantage from this promotion or abuse of this service or any illegal act or failure to comply with terms and conditions of this promotion;
